Mediation and Arbitration

There are a number of alternative dispute resolution mechanisms that allow individuals and or legal entities to settle a legal dispute outside of court. In general, this tends to be more cost-effective and swifter.

These alternative dispute resolution mechanisms are common in mediation and arbitration. As with litigation, arbitration makes use of an adversarial approach to dispute resolution. However, instead of a court-appointed judge, the arbitrator is an independent private person, such as a senior advocate or attorney, decided upon by the parties involved.

This often leads to a more robust, practical, time-efficient and cost-effective manner of resolving disputes.

Most business owners who have been involved in legal battles will tell you that at the end whether they won in court or not -they still lost.

For this reason we at Hahn & Hahn pride ourselves in firstly trying to resolve disputes between parties by way of Commercial Mediation and thereby reaching a win-win situation as supposed to a lose-lose situation.

Mediation is the process whereby the mediator facilitates discussions between the parties in order for them to explore the possibility of resolving issues between them without an individual deciding for them who is right and who is wrong.

For us, Mediation is not an Alternative Dispute Resolution mechanism but rather an Appropriate Dispute Resolution mechanism.

Our firm partner, Jaco Hamman, has been a court-annexed mediator since 2014 and a member of the ADR International Register since 2016. The firm has extensive experience and has assisted numerous clients, from individuals to large corporate entities, in successfully resolving their disputes via these resolution mechanisms. The firm is therefore extremely capable of handling and resolving all sorts of disputes, ranging from various clients in all economic sectors.
