Electricity Law Dispute Resolution Services

Illegal Disconnection of Electricity Supply

Municipalities and Eskom are bound to follow electricity disconnection procedures. Electricity may not be disconnected without notice. Our firm assists clients in the reconnection of illegally disconnected electricity supply and any potential damages that result from same.

Incorrect Electricity Account Billing

We have a vast majority of clients who have difficulties with the accounts and billing issued by municipalities, Eskom and landlords.

We assist clients in relation to incorrect electricity accounts and billing records which typically result from charges made as a result of an incorrect or malfunctioning meter, leaks, estimated charges, incorrect reconciliations, and incorrect tariff applications which may also lead to threats or actual disconnections in relation to these types of charges.

Additionally, we assist with calculations of usage of electricity to determine the correct charges to be applied in terms of the tariffs and municipality bylaws.

Disputes Between Landlords and Tenants of Commercial Companies

Landlords and tenants will usually have clauses in their lease agreements regulating electricity and landlords often times have third parties reading and/or managing the electricity meter readings of the buildings owned by the landlord.

We assist clients on disputes in respect of matters such as overcharges of electricity either managed by the landlord or the third-party meter reader which resulted in leaks, incorrect tariffs, malfunctioning or faulty meters, incorrect calculation of usage of electricity and any other related matters.

Electricity Tariff Disputes and Application of Different Types of Tariffs

Commercial and business entities are charged with different types of tariffs which are approved by the National Energy Regulator South Africa.

We assist clients in determining whether they have been charged on the correct tariff and whether municipalities, Eskom or landlords are charging within the confines of the tariff. Examples of tariff disputes we deal with are where there are added charges to accounts, which do not form a part of the tariff; a different tariff is being charged; request for changes of a tariff and other related tariff matters.

Institution and Defending Actions in Courts and Arbitration Proceedings

We assist clients in actions and arbitration proceedings which may result in cases such as breaches of contract between landlords and tenants of business and commercial entities; claims for damages as a result of electricity disconnection; approaching the courts on an urgent basis to restore electricity supply; claiming performance or reviewing decisions of municipalities, Eskom and the National Energy Regulator of South Africa.

Addressing the Electricity Supply and Pricing Crises for Commercial Entities

Commercial entities suffer far reaching consequences due to the imbalances in electricity supply and pricing. We assist commercial entities in addressing imbalances which occur as a result of incorrect or faulty metering, incorrect or incomplete charges, electricity disconnections without notice, electricity disconnection and reconnection procedures, damages claims as a result of the conduct of municipalities and other governmental entities, compliance with electricity regulated laws.
